Terms of Service

1. Agreement to Terms

By accessing or using the TradeSwarm platform ("Service"), operated by TradeSwarm AI ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TradeSwarm provides AI-powered employee swarms for trades businesses, including automated phone answering, SMS/text messaging, email communications, lead qualification, appointment scheduling, dispatching, invoicing, and follow-up services. The Service utilizes artificial intelligence agents that operate under human supervision with multiple safeguard layers.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old and authorized to enter into this agreement on behalf of your business.

4. TCPA Compliance & Telecommunications Disclosure

By using TradeSwarm, you acknowledge and consent to the following:

  • AI agents will make and receive phone calls and text messages on your behalf using your business phone number(s).
  • You are responsible for obtaining proper consent from your customers before AI agents contact them, in compliance with the Telephone Consumer Protection Act (TCPA).
  • AI agents will identify themselves as automated systems when required by law.
  • You must maintain a do-not-call list and ensure AI agents comply with customer opt-out requests.
  • Call recordings and transcripts are stored securely and may be used for quality assurance, training, and service improvement.
  • Standard messaging and data rates may apply to SMS communications. Message frequency varies based on your swarm configuration.

5. Data Collection & Anonymized Benchmarks

By using the Service, you consent to the following data practices:

  • We collect interaction data (calls, texts, emails) processed by your AI swarms for service improvement.
  • We auto-label and embed interaction data to improve AI agent performance for your account.
  • We create anonymized, aggregated benchmark data from usage across all customers. This data cannot be traced back to your business or your customers.
  • Anonymized benchmark data may be used for industry reports, product improvement, and may be made available to other customers for comparison purposes.
  • Your raw, identifiable data is never shared with third parties without your explicit consent.

6. AI Agent Limitations

You acknowledge that AI agents may occasionally produce incorrect, incomplete, or inappropriate responses despite our 7-layer safeguard system. You agree to:

  • Configure escalation rules for high-risk interactions.
  • Review flagged interactions promptly.
  • Not hold TradeSwarm liable for business decisions made solely based on AI agent output.
  • Maintain human oversight of AI agent operations.

7. Subscription & Billing

Subscriptions are billed monthly. Free trials last 14 days with full access to the selected plan tier. You may cancel at any time. Refunds are not provided for partial months. We reserve the right to change pricing with 30 days notice.

8. Data Ownership

You retain full ownership of your business data, customer information, and knowledge base content uploaded to TradeSwarm. You may export your data at any time. Upon account termination, we will retain your data for 30 days before permanent deletion, unless you request earlier deletion.

9. Prohibited Use

You may not use TradeSwarm for illegal activities, spam, harassment, deception, or any purpose that violates applicable laws or regulations. We reserve the right to suspend or terminate accounts that violate these terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADESWARM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

11. Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
